Die Pressemitteilung der Hohen Kommissärin für Menschenrechte des Europarats, Dunja Mijatović, ist fast einen Monat alt, doch sie ist nach wie vor von höchster und beschämender Aktualität. Es geht um SLAPPs, den Missbrauch der Justiz zum Zweck der Einschüchterung, genauer um »strategische Klagen gegen die öffentliche Partizipation« (strategic lawsuit against public participation).

Neben anderen prominenten Fällen wird in der Aussendung auch Südtirol genannt, wo LR Arnold Schuler (Landwirtschaft, SVP) und zahlreiche Obstbauern gerichtlich gegen das Umweltinstitut München, dessen Agrarreferent Karl Bär (Grüne) und Alexander Schiebel vorgehen.

In Italy, where defamation is still a criminal offence, several journalists have been targeted by malicious lawsuits with the sole aim of silencing them and draining their time and financial resources. One such example is Federica Angeli, a journalist under threat who is known for her thorough investigations into the Mafia, and has had to fight over 120 lawsuits. In another current case in South Tyrol, criminal court proceedings have been brought by the provincial councillor in charge of agriculture and by apple farmers against environmental activists and the publisher of a book denouncing the high levels of pesticide use in the region.

These are just a few examples of abusive lawsuits intended to intimidate and silence critics. Commonly known as “SLAPPs”, these suits pose a significant and growing threat to the right to freedom of expression in a number of Council of Europe member states, perverting the justice system and the rule of law more generally.

Die Methoden des Umweltinstituts muss man nicht mögen, doch das ändert nichts daran, dass jene des Landesrats und der Obstbauern in einer modernen Demokratie inakzeptabel sind. Sie machen sich rückständige Besonderheiten des italienischen Rechtssystems zueigen, um Aktivisten einzuschüchtern und mundtot zu machen.

Dass es die Münchner Staatsanwaltschaft abgelehnt hat, das Bozner Gericht in dieser Sache zu unterstützen, spricht Bände und sollte — genauso wie die Pressemitteilung von Mijatović — die Alarmglocken schrillen lassen.

Statt mit offensiver Transparenz, Informationen und einer zeitgemäßen Umweltpolitik zu reagieren, macht sich Südtirol auf internationalem Parkett einen schlechten Namen. Noch gefährlicher ist aber das Signal, das an Aktivistinnen im Land und darüber hinaus ausgesandt wird: wir diskutieren mit euch nicht auf Augenhöhe, sondern führen Prozesse, die für euch sehr teuer werden können.

    Zumindest wird mal der Name “South Tyrol” erwähnt und das auch noch von einer europäischen Organisation.
